The basics

Compliance is a calendar, not a one-off

Under the Renting Homes (Wales) Act 2016 and related law, a compliant let needs a set of documents in place - and most of them expire. The hard part isn't getting them; it's knowing which ones are due and when. A compliance check finds the gaps before they become legal problems, and gives you a renewal schedule you can actually keep to.

Deposit protection Any deposit taken is held in a government-approved scheme and the prescribed information has been served. Within 30 days
Written statement of the occupation contract The contract-holder has been given the written statement setting out the terms of their occupation contract. Within 14 days
Rent Smart Wales The property is registered and the landlord or managing agent holds the required licence. Ongoing
Legionella risk assessment The water system has been assessed for legionella risk and the assessment is kept under review. Reviewed

Alarms are part of the picture too

Beyond the certificates, a fit-to-let property needs mains-wired, interlinked smoke alarms on every storey, and carbon monoxide alarms by fuel-burning appliances. These aren't a once-and-done job - they should be checked regularly to stay compliant.

Deposit protected within 30 days, prescribed information served, and the written statement of the occupation contract provided within 14 days.

Licensing

Rent Smart Wales registration and licence in place, plus an HMO licence where the property meets the threshold.

Water safety

A legionella risk assessment carried out and reviewed for the water system.

Standards & exemptions

EPC band against the Minimum Energy Efficiency Standard and whether any limited exemptions apply.

Why it matters

You can't end a contract while non-compliant

A landlord can't serve a Section 173 notice to end an occupation contract while compliance obligations are outstanding. Missing a certificate or a registration doesn't just risk penalties - it can leave you unable to regain possession when you need to. Catching the gaps early keeps that route open.
